Senate Bill Would Require Frontier AI Contractors to Report Security Incidents to DoD Bipartisan Bill Targets Insider Threat Reporting at the Pentagon’s AI Vendors
Senators Jim Banks and Kirsten Gillibrand introduced S. 5601, the Insider Threat Reporting and Security Guidance Act of 2026, on September 29, and it went to the Senate Armed Services Committee. The bill would give the Secretary of Defense 180 days after enactment to issue regulations setting reporting requirements for covered AI contractors, defined to include companies holding DoD AI agreements worth $100 million or more. Those companies would report their model security policies and practices, who has access to model weights and training, suspected material incidents affecting the security, integrity, or availability of their models, unauthorized access, exfiltration or sabotage of data or models, past evasions of safeguards, and unprompted autonomous actions. They would recertify the accuracy of what they submitted at least every 90 days, report national security incidents such as theft of model weights within 72 hours of discovery, and report material vulnerabilities within seven days of determining materiality. The bill also calls for voluntary guidance aimed at large commercial frontier AI contractors.
